If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. JRI and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

Reviews, Comments, Emails and Suggestions

All information and suggestions that may be provided to JRI about its products, including concepts, ideas, sketches, art work, files and other materials shall become the property of JRI and the provider agrees to forfeit to JRI all legal and intellectual property rights it might have in regard to such materials and information. JRI is under no obligation to use or return any information or materials provided.

Risk of Loss

All items purchased from JRI are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Force Majeure

Jordan River Industries, LLC (JRI) shall not be held liable for any failure or delay in performance caused by events beyond its reasonable control, including, but not limited to, acts of God, natural disasters, pandemics, epidemics, acts of government or regulatory authorities, war, terrorism, labor strikes, supply chain disruptions, power outages, or other unforeseen circumstances.
In the event of a force majeure situation, JRI’s obligations under these Terms and Conditions shall be suspended for the duration of the event. JRI will make reasonable efforts to minimize the impact of such events and resume performance as soon as practicable.
JRI shall not be liable for any damages or losses resulting from delays or non-performance due to force majeure events. If the force majeure event prevents JRI from fulfilling its obligations for an extended period, JRI reserves the right to cancel the affected order(s) and provide a refund for any payments made for undelivered products.

Duties and Taxes

Import duties, taxes, and brokerage fees are not included in the product price or shipping and handling cost and it will be collected upon delivery from the carriers for certain packages. These charges are recipient’s responsibility as JRI is only charging the transportation fee for the packages. You may check with your country’s customs office to determine what these additional costs will be.

Applicable Law

By visiting the JRI web site, you agree that the laws of the state of California, without regard to principles of conflict of laws, will govern these Web Site Terms and Conditions of Use and any dispute of any sort that might arise between you and JRI or its associates. Venue for filing any claim against JRI shall be in California in the then County where JRI has its principal office.

Arbitration Clause 

Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, including but not limited to the use of this website, the purchase of products, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively through binding arbitration. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be held in Los Angeles, California, USA, unless otherwise agreed by both parties. Each party shall bear their own costs and attorney’s fees unless the arbitrator determines that the claim was frivolous or filed in bad faith, in which case the prevailing party may recover costs and fees. The arbitrator shall have the authority to award any relief available in court under applicable law and shall issue a written decision detailing the award and reasoning. By agreeing to these terms, you waive your right to a trial by jury and participation in any class-action lawsuit. This clause does not preclude you from bringing an individual claim in small claims court if your claim qualifies.

Your privacy is very important to us. Accordingly, we have developed this privacy policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. Your personally identifiable information includes information about you personally or any other information that permits a person to be contracted physically or online.

The following outlines our privacy policy which is effective as of October 17, 2023:

• Users may enter and view our web site anonymously.
• We do ask for personal information for purposes of registration, and ordering. We will give you the option to opt out of our mailing list and receiving new product and promotional materials directly from us.

• If you are under 18, you may use our website only with involvement of a parent or guardian. JRI reserves the right to refuse service, terminate accounts, and delete confidential information at its sole discretion.
• JRI does not track its customers over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. If you opt out of being tracked when you provide personal information to us, we will ensure that new data collected about you will not be used by us for advertising purposes.

We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained.

Our online store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase.

If you are not comfortable with our privacy policy please do not submit any personal information or use this web site to order product. You must consent to this policy before you may order products or create an account. By using our web site to order products you are consenting to this privacy policy.

Return and Replacement Policy

Returns

You may return most Crystal Fortress® products within 30 days of receipt or delivery of your order for a refund. Refunds do not include original shipping & handling charges. Returned products must be complete, undamaged, unused, and in the original packaging. A product with acrylic panels will be considered used if the protective film of any acrylic panel has been removed. Altering parts and components, or re-fabricating any part of a Crystal Fortress product or accessory will automatically void all warranties.

We cannot offer you a refund after 30 days from receipt or delivery of your order.

This policy does not apply to items purchased from a retail outlet. Please follow the guidelines as set forth in the retailers return policy if applicable.

Non-refundable items:

- Gift cards

- Partial bulk packaged items

- Individual products purchased as part of a bundle or system. All bundled products must be returned together to be considered for a refund.

Return Instructions:

1. Contact us at team@crystal-fortress.com and request a return.

2. Please include your name, order number, the item(s) you wish to return, and a brief explanation of why you wish to return the item(s).

3. We will verify that the item(s) fall within the return guidelines and email you with a Return Authorization Number (RAN). Packages will not be accepted without an authorized RAN.

4. Once your return is approved, a Customer Associate will provide you with the appropriate return address.

5. When shipping the item(s) back to us, please include a note with your name, order number, RAN, and contact information to ensure proper processing.

Refunds

You will receive an email to let you know your return has been received and the approval status of your refund. If your return is accepted a 10% restocking fee will be deducted from your total refund amount. Your refund will be processed within 30 days. A credit will automatically be applied to your credit card or original method of payment for a refund.

If the refund is rejected, your product can be returned to you at your request.  Let us know within 60 days if you would like the product shipped back to you with any specific instructions as well as how you would like to pay for the shipping and handling costs. You will have an additional 30 days to make the payment after which your product will be discarded.

Late or missing refunds

If you have not received a refund after 30 days, please verify your account. Note that the official posting of the refund to your account may take some time. Please contact us at team@crystal-fortress.com with any questions.

Shipping

To return an item(s), please follow the Return Instructions above.

You are responsible for paying shipping costs for returning your item(s). Original shipping costs are non-refundable and will not be included in the total refund amount.

Jordan River Industries, LLC (JRI) does not take responsibility for any damage to returned product from shipping or lost packages. We highly recommend you use a trackable shipping service and purchase shipping insurance. Items damaged during return shipping will not be accepted so please package products carefully. You will need to file a claim with your shipping insurance to be compensated for the damaged goods.

Replacements

Within 30 days of receipt or delivery of your order, JRI will replace, send a repair kit, or refund the cost of any defective, damaged, or missing part(s).  Depending on the customers shipping address and parts requested, shipping & handling cost may occur.

To receive a replacement, email us at team@crystal-fortress.com with your name, order number, and a brief description of the problem. For damaged, or defective parts, you must include 1-2 photos of each part that clearly shows the whole part and the damaged area(s), and a photo of the shipping box the order came in. 

Marks and scratches are not considered defective. Heat scarring is not considered defective. Damage to packaging is not considered defective. Packaging is defined as any box, poly bag, shrink wrap, and/or any material that is used to secure the product.  JRI reserves the right to determine if a part is damaged or defective.

Damaged parts due to user error or mishandling of the product are not covered in this policy. If you broke a part, send us a replacement request as stated in the following paragraph to purchase new parts.

After 30 days of receipt or delivery of your order, replacement parts can be purchased directly through JRI unless the product is permanently discontinued. You will be responsible for all shipping & handling costs. An email with the same requirements as stated above is required to receive your replacement parts.

Exchanges

JRI does not offer exchanges. If you ordered an incorrect product, you can return the product as per the terms as stated for REFUNDS in this policy. If your purchase includes defective or damaged parts you can receive replacement parts as per the terms as stated for REPLACEMENTS in this policy.

Cancelled Orders

To cancel an order, email us at team@crystal-fortress.com, and one of our Customer Associates will reach out to discuss your concerns and explore options to resolve the issue. We require direct confirmation from you during this process before canceling your order. If we are unable to receive confirmation after making reasonable efforts to contact you, the order will be shipped as scheduled. Once shipped, it will be your responsibility to follow the return process outlined in this policy if further action is needed.

Indemnification

You agree to indemnify, defend, and hold harmless Jordan River Industries, LLC (JRI), its affiliates, officers, directors, employees, agents, licensors, suppliers, and successors from and against any and all claims, losses, liabilities, damages, expenses, and costs (including, but not limited to, reasonable attorneys' fees) arising out of or related to:
1. your breach of these Terms and Conditions;
2. your violation of any law or the rights of a third party;
3. your use or misuse of our website, products, or services, including any modifications or alterations you make to Crystal Fortress products; or
4. any claim by a third party that arises from content you submit, post, or transmit through our website or platforms.
This indemnification obligation shall survive the termination of these Terms and Conditions and your use of this website, products, or services.
